Terms of Service
Effective as of: July 9, 2026
These Terms of Service (the “Terms”) govern every use of the website located at mainspringgaragedoorseattle.com and every service request submitted through it. By accessing mainspringgaragedoorseattle.com, browsing its pages, or submitting a service request in any form, a visitor or user (referred to herein as “User”) agrees to be legally bound by these Terms in their entirety. If the User does not agree, the User must not use the website or submit any request.
Important Notice - Arbitration and Class-Action Waiver: These Terms contain a binding arbitration agreement and a waiver of the right to bring or participate in a class action. Both provisions are set out in the Dispute Resolution section below. Users are encouraged to read that section carefully before using the site.
These Terms apply to all visitors, registered users, and any other persons who access or use mainspringgaragedoorseattle.com. Mainspring Garage Door Co. of Seattle reserves the right to update these Terms at any time as described in the Changes section below.
Limitation of Liability
mainspringgaragedoorseattle.com and the referral service offered through it are provided on an “as is” and “as available” basis. Mainspring Garage Door Co. of Seattle makes no representation or warranty - express, implied or statutory - that any independent business will be available to accept a referral, will contact the User within any particular timeframe, or will produce any particular result.
To the fullest extent permitted by applicable law, Mainspring Garage Door Co. of Seattle shall not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, including but not limited to lost profits, loss of data, or damage to property, arising out of or in connection with the User’s use of mainspringgaragedoorseattle.com or the referral service, even if Mainspring Garage Door Co. of Seattle has been advised of the possibility of such damages.
In all events, the total cumulative liability of Mainspring Garage Door Co. of Seattle to any User for any claim arising out of or relating to mainspringgaragedoorseattle.com or the referral service - regardless of the form of the action or the theory of recovery - shall not exceed the greater of (a) one hundred dollars ($100.00) or (b) the total amount the User actually paid directly to Mainspring Garage Door Co. of Seattle in connection with the specific transaction giving rise to the claim, which in most cases is zero.
This limitation applies solely to Mainspring Garage Door Co. of Seattle’s own conduct and obligations. Responsibility for the quality, safety, timeliness, and outcome of any work performed rests exclusively with the independent business that performed it. Nothing in this section limits or caps the liability of any such independent business for its own acts or omissions.
Text Messaging and Telephone Communications
By submitting a service request through mainspringgaragedoorseattle.com, the User expressly consents to receive calls and text messages (SMS/MMS) from two categories of senders: (1) Mainspring Garage Door Co. of Seattle itself, and (2) the independent business or professional to whom Mainspring Garage Door Co. of Seattle forwards the User’s service request for follow-up and scheduling purposes.
The User’s consent encompasses communications placed using an automatic telephone dialing system (autodialer) and messages that use a prerecorded or artificial voice, in addition to manually dialed calls and standard text messages.
Consent is not a condition of purchase. Agreeing to receive calls or text messages is not required as a condition of purchasing any goods or services, and the User may still submit a request and receive a referral without granting such consent where permitted by law.
Message frequency will vary depending on the nature of the User’s request and the response of the independent business handling it. Standard message and data rates may apply, as determined by the User’s wireless carrier.
To stop receiving text messages from any sender, reply STOP to that message at any time. To request assistance, reply HELP. Please note that opting out of text messages does not automatically cancel other forms of contact (such as phone calls) regarding an open service request unless the User separately requests that such contact cease.
Users who prefer to manage their communication preferences or submit an opt-out request in writing may do so through https://mainspringgaragedoorseattle.com/contact-us/.
Governing Law and Venue
These Terms shall be governed by and construed in accordance with the laws of the State of WA, without giving effect to any conflict-of-law principles that would require the application of the laws of another jurisdiction.
Subject to the binding arbitration agreement set forth in the Dispute Resolution section above, any legal proceeding that is permitted to be brought in court shall be filed exclusively in the state or federal courts located within WA, and both Mainspring Garage Door Co. of Seattle and the User irrevocably consent to the personal jurisdiction and venue of those courts for such purposes.
Warranty Disclaimer and Coordination Remedy
Mainspring Garage Door Co. of Seattle performs no home-service work of any kind. Accordingly, Mainspring Garage Door Co. of Seattle gives no warranty, express or implied, with respect to workmanship, labor, parts, materials, or the outcome of any job. Any warranty on work performed is solely that of the independent business that performed the work, on whatever terms that business provides. Any warranty on parts or materials is solely that of the manufacturer, on the manufacturer’s own terms. Users should request warranty terms in writing directly from the performing business before authorizing any work.
If a User is dissatisfied with the result of a job, the sole remedy Mainspring Garage Door Co. of Seattle offers is coordination assistance as a courtesy: upon request, Mainspring Garage Door Co. of Seattle will contact the performing business and ask that it return to address the concern, or, if appropriate, refer the request to a different business within its referral network. This coordination effort is a courtesy only - it is not a guarantee of any particular outcome, resolution, or correction of defective work.
Mainspring Garage Door Co. of Seattle will not itself perform, redo, repair, or supervise any work under any circumstances. This coordination assistance does not entitle the User to a refund of any amounts paid to the performing business, nor does it constitute any guarantee or promise that the work will be redone or corrected to the User’s satisfaction.
Pricing, Estimates, and Payment
All prices, estimates, and quotes relating to home-service work are determined solely by the independent business that responds to a User’s request. Any price range, starting figure, or example price that appears on mainspringgaragedoorseattle.com is illustrative only and does not constitute a binding quote or offer.
The final price for any job is set by the performing business after it has had an opportunity to evaluate the specific scope of work, and that price may differ from any figure displayed on the site. Mainspring Garage Door Co. of Seattle does not collect payment on behalf of any performing business, is not a party to any pricing agreement between the User and the performing business, and does not guarantee any price, discount, promotional offer, or coupon that any business may represent.
Users should obtain a written estimate from the performing business and confirm all pricing before authorizing work to begin.
Severability
If any provision of these Terms is held by a court or arbitrator of competent jurisdiction to be invalid, illegal, or unenforceable under applicable law, that provision shall be modified to the minimum extent necessary to make it enforceable, or if modification is not possible, it shall be severed from these Terms. The remaining provisions shall continue in full force and effect as if the severed provision had never been included.
Notwithstanding the foregoing, the class-action and representative-action waiver contained in the Dispute Resolution section is not severable from the arbitration agreement in that section. If the class-action waiver is found to be unenforceable with respect to any claim, the arbitration agreement shall not apply to that claim, and that claim shall be resolved in a court of competent jurisdiction rather than through arbitration.
Modifications to These Terms
Mainspring Garage Door Co. of Seattle reserves the right to revise, amend, or replace these Terms at any time and for any reason, in its sole discretion. When changes are made, the revised Terms will be posted at mainspringgaragedoorseattle.com, and the Last Updated date shown on the page will be updated to reflect the effective date of the revision.
The User’s continued access to or use of mainspringgaragedoorseattle.com after revised Terms have been posted constitutes the User’s acceptance of and agreement to those revised Terms. If the User does not agree to a revised version, the User must discontinue use of the website. It is the User’s responsibility to review these Terms periodically.
Indemnification
The User agrees to indemnify, defend, and hold harmless Mainspring Garage Door Co. of Seattle, its owners, officers, directors, employees, and affiliates, as well as each independent business within its referral network, from and against any and all claims, demands, actions, proceedings, damages, losses, liabilities, costs, and reasonable attorneys’ fees arising out of or related to any of the following:
- The User’s access to or use of mainspringgaragedoorseattle.com;
- The information the User submits through the site, including any inaccuracies therein and the User’s authority to provide the telephone number and other contact details supplied;
- The User’s breach of any provision of these Terms or violation of any applicable law or regulation; and
- The User’s dealings, transactions, or disputes with any independent business to which the User has been referred.
This indemnification obligation shall survive the termination or expiration of the User’s use of mainspringgaragedoorseattle.com and shall remain in effect regardless of any such termination. Mainspring Garage Door Co. of Seattle reserves the right, at its own expense, to assume exclusive defense and control of any matter subject to indemnification, in which case the User agrees to cooperate fully with Mainspring Garage Door Co. of Seattle in asserting any available defenses.
Independent Contractors and Partner Liability Disclaimer
Each business that performs work in connection with a referral from mainspringgaragedoorseattle.com is an independent contractor. No such business is an employee, agent, legal representative, joint venturer, or partner of Mainspring Garage Door Co. of Seattle in any sense, and Mainspring Garage Door Co. of Seattle exercises no control over how any such business carries out its work.
Mainspring Garage Door Co. of Seattle is not responsible or liable, in whole or in part, for the workmanship, quality, safety, or timeliness of any work performed by an independent business; for that business’s pricing or billing practices; for its compliance with licensing, bonding, or insurance requirements; for the conduct of its employees or subcontractors; or for any act, omission, negligence, property damage, personal injury, or other loss caused by that business or any person acting on its behalf.
The contract for any home-service work is formed directly and exclusively between the User (as customer) and the independent business that performs the work. Mainspring Garage Door Co. of Seattle is not a party to that contract and assumes no obligations under it. A referral made through mainspringgaragedoorseattle.com does not constitute an endorsement, certification, or guarantee of any business, its personnel, its work, or its fitness for any particular purpose.
Before authorizing any work to begin, Users are strongly advised to verify the business’s current licensing and insurance status and to obtain and read a written contract setting out the full scope, price, and terms of the work. Any dispute arising out of or related to work performed is a matter solely between the User and the performing business.
Dispute Resolution, Arbitration, and Class-Action Waiver
Informal Resolution. Before initiating any formal legal proceeding, the User agrees to contact Mainspring Garage Door Co. of Seattle through https://mainspringgaragedoorseattle.com/contact-us/ and provide a written description of the dispute, giving Mainspring Garage Door Co. of Seattle a reasonable opportunity - no fewer than thirty (30) days - to resolve the matter informally. Many concerns can be addressed without formal proceedings.
Binding Arbitration. Any dispute, claim, or controversy arising out of or relating to these Terms, mainspringgaragedoorseattle.com, or the referral service that is not resolved informally shall be settled exclusively by binding arbitration administered by the American Arbitration Association (AAA) under its Consumer Arbitration Rules, as amended from time to time, rather than in a court of law. By agreeing to these Terms, both the User and Mainspring Garage Door Co. of Seattle waive the right to have such disputes resolved by a judge or jury in court, except as expressly provided below.
Class Action Waiver. All claims subject to arbitration must be brought solely in the User’s individual capacity. Neither the User nor Mainspring Garage Door Co. of Seattle may bring or participate in any class action, collective action, consolidated action, or any class or representative arbitration proceeding of any kind. The arbitrator has no authority to consolidate more than one person’s claims or to preside over any form of class or representative proceeding. This class action waiver is a material term of these Terms.
Jury Waiver. To the extent any claim proceeds in a court of competent jurisdiction as permitted herein, both the User and Mainspring Garage Door Co. of Seattle irrevocably waive the right to a trial by jury.
30-Day Opt-Out Right. A User who does not wish to be bound by the arbitration agreement may opt out by sending written notice of that election to Mainspring Garage Door Co. of Seattle through https://mainspringgaragedoorseattle.com/contact-us/ within thirty (30) days of the date the User first accepts these Terms. Timely opting out of arbitration has no effect on any other provision of these Terms.
Small Claims and Injunctive Relief. Notwithstanding the foregoing, either party may bring an individual claim in a small claims court of competent jurisdiction, provided the claim qualifies and remains in that court. Either party may also seek emergency injunctive or other equitable relief in a court of competent jurisdiction to prevent the actual or threatened misuse of mainspringgaragedoorseattle.com or infringement of intellectual property rights, without first engaging in informal resolution or arbitration.
